Sub: Regarding Exemption of Physically Disabled persons from                      
                 Duty

          I would like to bring your kind attention to the DOPT OM No 11013/9/2014 ESH (A III) dated 27th march 2020 under which the instructions to all the departments have been issued to draw the roster of officials to attend the essential services during lock down period while doing so the Physically disabled persons must be exempted from duty. This is to intimate that the circles have not followed the uniform roster system across the country. In many circles the roster system is not followed at all. Apart from this the Physically Disabled persons have not been exempted from duty during the lock down period. Therefore my federation urges to direct all the heads of circles to follow the roster system in drawing officials for essential service during the lock down period. Further union urges to direct to all the Heads of circles to cause action to exempt the physically disabled officials from duty.


            Secondly during lock down period Post offices/RMS offices could not be opened during lockdown period. The Ministry of Finance vide memo No F.No.23 (4)/E. Coord/202O/I dated 23/3/2020 ordered payment of wages to part time workers/ outsourced persons irrespective they worked or not during the lockdown period. Thus it is treated as duty though the offices did not function during the lock down period. The department has not issued the similar order in respect of the employees. The situation is extraordinary and offices were forced to close down. Thus officials were not on leave on their own it is due to lock down, Curfew or 144 section imposed. As offices could not be opened and operated the officials could not attend the duties. Therefore it is requested to cause action to issue orders treating the absence from duty during the Lock down period as duty for all purpose. The many Circles/Divisions are following the procedure as per their own interpretation which is not correct. This being the National Medical Emergency it is requested to cause orders treating the period as duty during the Lock Down period.

          Early action on the aforesaid issues is requested so that there is uniformity of procedure and implementation in entire country.
