Subject: Nature of disciplinary action and quantum of punishment to be commensurate with the gravity of the offence committed- reg.
Madam / Sir,
It has been observed by the Competent Authority that in some of the Rule9 cases submitted to this office for Presidential Order the charge sheets under Rule-l4 of CCS (CCA Rules, 1965 are issued to the officials in cases having low gravity of offence committed by the delinquent officials immediate$ before their retirement. These proceedings are deemed to be continued under Rule-9 of CCS (Pension) Rules, t972 after their retirement.
It has been observed by the Competent Authority that in some of the Rule9 cases submitted to this office for Presidential Order the charge sheets under Rule-l4 of CCS (CCA Rules, 1965 are issued to the officials in cases having low gravity of offence committed by the delinquent officials immediate$ before their retirement. These proceedings are deemed to be continued under Rule-9 of CCS (Pension) Rules, t972 after their retirement.
On examining such cases, the misconduct
or negligence cannot be established grave enough which warrants
imposition of penalty by way of withholding pension / gratuity or both
in terms of Rule-9 of CCS (Pension) Rules, 1972. As such the proposal is
dropped by the Competent Authority. This results in payment of interest
on delayed payment of Gratuity to the official.
Instruction on the subject matter have
already been circulated vide letter No 6/19/72Disc.1 dated 29.11.1972
(DG P&T order 2 below Rule’14 of CCS (CCA) Rules, 1965). It is,
therefore, reiterated that in future while issuing charge sheet to the
delinquent officials, the Disciplinary Authority should determine the
with care and deliberation gravity of office and nature of action to be
taken in each case on its merits.

Subject: Representation from Government servant on service matter -regarding.
Sir/madam,
I am directed to refer to this Department’s letter of even number dated 13-10-2016, 27-03-2017 and 24.07.2017 on the above mentioned subject, wherein instructions have been issued on direct submission of representations by Government servants for their service matters. In spite of these instructions, it has been observed that Government servants are still continuing to represent directly to the Hon’ble President of India, Prime Minister office, Union Ministers, Cabinet Secretariat and other higher authorities of Department of posts.
2.Such action on the part of the Government servants has been viewed seriously in the Directorate. It is, therefore, reiterated that such submission of representations including through email or public grievance portal directly to other authorities by passing the prescribed channel of communication would be treated as unbecoming conduct attracting the provisions of RuIe 3 (1) (iii) of the central civil services (conduct) Rules 1964 and invite action under the provision of Rule 20 of central civil service (conduct) Rules 1964 prohibiting Government servant from bringing outside influence in his service matter.
3.It is also clarified that representation by relatives of Government servant is also treated as outside influence as clarified vide MHA OM No. F. 25121/63-Estt.(A) dated 19.09.1963. Further, the competent authority for redressal of grievance of all non-gazetted employees are in the respective circle only. As such, the service matter of the all such employees must be settled in the concerned Circles only.
In view, of the above, you are requested to bring these instructions to the notice of all officers and staff and sensitize them to submit their representations to their immediate officers or to the officer designated to dispose of grievances.

OFFICE MEMORANDUM
Subject: Calling for willingness to work in Directorate on deputation/attachment basis.
This is regarding of officials from
Postal Circles upto the level of Assistant Superintendent of Posts in
the Department on deputation and attachment basis. Guidelines in this
regard have been issued vide letter no.7-12/2017-SPB-II dated 04 April,
2018.
2. Willingness from eligible officials
in the cadre of Assistant Superintendent of Posts and Inspector Posts is
hereby called for to prepare a panel of officials to be posted in
Directorate on deputation/attachment basis as and when need arises. This
panel of officials shall be valid upto 31.03.2020.
3. All the willing officials are advised
to go through Deputation/attachment guidelines and ensure their
eligibility before submitting willingness. Further terms and conditions
of deputation or attachment are also available in the said guidelines,
which is available on India Post website under ‘Right to Information
Deputation/attachment guidelines’
4. Willing officials shall submit their
willingness addressed to DDG(personnel), Dak Bhawan, Sansad Marg New
Delhi along with filled-in proforma enclosed herewith. willingness
should be sent only through eMail (scanned copy) latest by 10.05.2019
and hard. copy of application need not be sent to Directorate.
Consideration of willingness received after 10.05.2019 will be at sole
discretion of Directorate. Applying for deputation / attachment shall
not entail any right for posting in Directorate. willingness should be
sent through email at adgspn@indiapoit.gov.in
